CSPAN has the debate on now (Senate Continues Debate On Judge Sotomayor). On its website it has a tally of confirmed YEA or NAY votes. There are seven Democratic Senators who have not either voted in the Judiciary Committee, made a public statement, or been independently confirmed by telephone.

Casey PA
Conrad ND
Levin MI
Lincoln AR
Rockefeller WV

This is the list as of noon Wednesday. Debate is scheduled to continue until 9PM tonight. The vote will be before the Senate recesses at the end of the week, but after travel promotion and the Cash-for-Clunkers are resolved.

I wonder if anyone has asked our two Senators if they have formed an opinion on what will influence their vote.

As of now there are 29 announced Republicans against the nomination (4.00 / 1)
There are still 4 who have not declared. Two, Gregg and Voinovich, are retiring.

Sen. Judd Gregg won $853,492 from the Powerball lottery after matching five of six numbers in Wednesday's drawing, adding to his already sizable wealth.

It seems to me that Sens. Byrd and Rockefeller both like to wait until the very last minute to let anyone know how they are going to vote.

I've not heard a thing that makes me think either one of them would vote against her. It would be nice if they would at least say something, as you ask, about how they are going to go about making their decision.

The CSPAN tally is up to 60 AYE, so will the decision be make to not have him come to the well.

Jay Rock announced he was against Alito on 30 Jan 2006 here before they voted on cloture that day, and the confirmation vote was the next morning. So it's about time, Jay.

Rockefeller made a favorable statement May 26 (4.00 / 2)
"Judge Sotomayor is an honorable and wise choice for the Supreme Court of the United States.  If confirmed, she will bring to the high court an almost unprecedented level of judicial and legal experience and a reputation for carefully balanced and research-based decision-making."

Don't know what counts as a public statement, but I'd take this as an indication of a yes vote unless he made some statement afterwards otherwise.


Sen. Byrd made a similar statement in May also (0.00 / 0)
Having him comparing her life story to that of his own rise from miner's son to Senator, leads me to believe he would favor her confirmation. He prefers judges not too far from center.

He came to the well for just the F-22 funding, actually probably voted from next to his desk since he is stickler for tradition, but I have no feeling whether this vote would be one he would not miss later in the week.

I think that counts as a public statement, a strong endorsement, and about as clear an indication of a yes vote as we're likely to get.

Steak Sauce Bayh is off the fence and has been confirmed by telephone to an AYE. Sen. Casey spoke in favor of her Tuesday night onthe floor. I don't know why this was so late to be added to their table. I must have missed this because I was listening to most of the speeches at least a little.

68 + 31 = 99 (didn't even need a calculator for that one!) All but Kennedy, I assume?

I thought maybe Sen. Mikulski(D-MD) might not make it (broken ankle needed surgery), like I was thinking maybe not Byrd. No, everyone was there, voted from their desks.

Birch Bayh's son was late as they had to skip his name. That's the *itch about having a "B" name.

Byrd and Mikulski left after that vote adn it looks like they did not participate in any of the Cash for Clunker drama. the Gee Oh Pee were going to kill it by amendment. Because President McCain told them to do it.

So if neither you nor Carnacki get my snark then all is lost.
