Prenter to get clean water by spring! No kidding!!

In one superheroic feat worth $2 million of your hard earned tax dollars, Governor Joe Manchin just relieved Massey Energy Co., Omar Mining Co., Independence Coal Co., Elk Run Coal Co. (doing business as Black Castle Mining Co.) and Pine Ridge Coal Co. LLC. from much of their liability for poisoning the aquifer supplying water to the communities of Prenter and Seth, WV.

Wouldn't it have been far cheaper for MoJo to have simply required the WV DEP to do the right thing in the first place?

The judge that refused to recuse himself from the coal slurry case has just had the case jerked out from under him.  Although it seemed pretty obvious that he was rilly rilly itchin' to gavel this one.

It's apparent that neither stevewvu nor his pal MoJo's "expert" Stout read the DEP report. (4.00 / 3)
Page 8 asserts:

"Certain constituents, such as alkalinity, Total Dissolved Solids, sulfates, and some organics, had migrated from the slurry into the mine pool that received the injection."

Hmmm. "Had Migrated" demonstrates unequivocally that the slurry has not been properly contained. Then Page 32 reveals:

"A comparison of the mine pools in adjacent deep mines where slurry did not occur supports the conclusion that injection activities impact mine pool water quality. Specifically, the water of the mine pool shows increased concentrations of total dissolved solids, alkalinity, and sulfates."

Finally, on page 33:

"Two of the four sites showed changes in water quality of the mine pool receiving injection. Certain constituents migrated from the slurry into the mine pool."

Since CSR 38-2-15.5.e.2 provides that discharges into underground mines are prohibited


"unless the operator demonstrates that such activities will not cause, result in, or contribute to a violation of water quality standards and effluent limitations both on or outside the permit area."

The WV DEP report quite tellingly reveals:

"Migration of the constituents from the mine pool to the surrounding groundwater was difficult to determine due to a lack of background information prior to injection and appropriate monitoring of by the operator. (emphasis added)

So regardless of whether or not the WV DEP acted on their own regs requiring water samples to be taken prior to coal slurry injection, the law actually [b]requires the OPERATOR[/b] to demonstrate coal slurry injection won't poison the water. source

Since the OPERATOR failed to take samples, the coal companies have the higher standard if they're to prove that they're NOT liable.

And stevewvu, if you think that the court won't take the testimony and health records of the people of Prenter and Seth into consideration, then the brackish mercury and arsenic laden BlankenAide you've been swilling has seriously impaired your brain.  I suggest that you contact your health insurance agent asap to see if he's willing to sue the coal company for your treatments rather than just drop you from coverage.

The coal companies are darned lucky I don't live in Prenter, because I would hold out for the court to make them restore my aquifer regardless of whether or not Bizarro Joe pipes in the city water.

Just imagine how many folks THAT would employ.

Those who lost family and friends in Prenter due to cancer caused by Massey poisoning their wells aren't likely to drop this case on your cockamamie assertion, or just because bizarro Joe pipes in the water.

At least not in the normal sense. As I said before, the burden of proof is obviously on the coal companies to prove that the heavy metal toxins DIDN'T come from coal slurry injection.

Perhaps you didn't get it the first time. Read it again, this time aloud if need be, stevewvu. And if that doesn't help, have someone read it to you.  S_L_O_W_L_Y

The report clearly states that the toxins weren't contained and that the coal companies didn't do any tests as required.  Other tests already show that the heavy metals are the same as whats contained in the coal slurry. So the biggest fight will obviously be over how much the mines will be required to do to compensate for their wrongdoing.

Anyone wanna bet that bizarro Joe WON'T file an "amicus brief" on behalf of even more scofflaw polluting companies before the end of his term?

plz link it....the burden is on the plaintiffs to show liability and damages...they have to prove the slurry contaminated the drinking water and that they've suffered damages......and i repeat  "But Stout couldn't say underground slurry was the cause of the water problems in the area"...they may say theres some leaching in to the "mine pool" but the passages you cite dont prove the slurry injection caused water problems for those particular plaintiffs...plus its kinda funny that the DEP, whom you believe are a bunch of bumbling idiots are now your experts...LOL!...

the coal companies will probably try to work out some sort of bargain.

And since you mention it, the coal companies may well try to work out that type of plea because

I know people who live up there.  This is right on par with Arch Moore deciding to accept one penny for every dollar that the coal company (can't remember which one) owed after the Buffalo Creek Mining Disaster.  Who knew Shelley Moore Capito had a super seekrit bizzaro brother?

It's just one more nail in the coffin of him getting the people to choose him to replace our beloved Senator Byrd (whose turds Manchin is not fit to whiff) when he dies...and you know he's waiting for that...you just know it.

I agree with Appalachian Voices, a more appropriate headline for the newspaper articles on the announcement would be "WV Town to go 8 More Months without Clean Drinking Water."

Help for Prenter citizens is long over due. If the WV DEP was doing its job well, this problem never would have happened. If it was doing its job at all, decisive action would have happened long ago.

I can understand why some many people are calling for a federal take-over of the WV DEP.
