Alison Knezevich reports that State Auditor Glen Gainer is also calling for a special election for Governor.
Gainer's office on Wednesday notified the state Supreme Court that it would file a legal brief in a case about whether acting Gov. Earl Ray Tomblin's plan to stay in office until 2012 is unconstitutional.
Gainer will file the brief Monday, spokesman Justin Southern said Thursday. The brief will argue that the state should hold a special election before 2012.
"We believe the [West Virginia] Constitution requires a special election," Southern said.

Earlier this month, the Supreme Court combined two lawsuits seeking a prompt election to replace Manchin. Those lawsuits were filed by West Virginia Citizen Action Group and South Charleston lawyer Thornton Cooper. Both argue that West Virginians should be able to elect Manchin's successor before 2012, when the state's next general election is scheduled.
The West Virginia AFL-CIO and the West Virginia Education Association have also filed court briefs calling for a special election.

All parties in the case must submit responses to the court by Monday.
